Notice on Data Transfers to Countries Not Deemed Safe Under Data Protection Law and Transfers to US Companies Not Certified under the DPF
We use, among other things, tools from companies based in countries that are not deemed safe under data protection law, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to and processed in those countries. We point out that no data protection level comparable to that in the EU can be guaranteed in these countries.
We point out that the USA, as a safe third country, generally has a level of data protection comparable to that of the EU. A data transfer to the USA is therefore permissible if the recipient holds a certification under the "EU-US Data Privacy Framework" (DPF) or possesses appropriate additional guarantees. Information on transfers to third countries, including the data recipients, can be found in this privacy policy.
Recipients of Personal Data
In the course of our business activities we work with various external parties. This sometimes requires the transfer of personal data to those external parties. We only pass on personal data to external parties if this is necessary as part of contract fulfilment, if we are legally obliged to do so (e.g. transfer of data to tax authorities), if we have a legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR in the transfer, or if another legal basis permits the data transfer. When using processors, we only pass on personal data of our customers on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.
Revocation of Your Consent to Data Processing
Many data processing operations are only possible with your explicit consent. You may revoke any consent you have already given at any time. The lawfulness of the data processing carried out prior to the revocation remains unaffected by the revocation.
Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)
IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING IS FOR THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 PARA. 1 GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21 PARA. 2 GDPR).
Right to Lodge a Complaint with the Competent Supervisory Authority
In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the member state of their habitual residence, their place of work or the place of the alleged violation. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedies.
Right to Data Portability
You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
Right of Access, Rectification and Erasure
Within the scope of the applicable statutory provisions, you have the right at any time and free of charge to obtain information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, a right to rectification or erasure of this data. For this and other questions on the subject of personal data, you can contact us at any time.
Right to Restriction of Processing
You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:
- If you dispute the accuracy of the personal data stored by us, we generally need time to verify this. For the duration of the review, you have the right to request the restriction of the processing of your personal data.
- If the processing of your personal data was/is unlawful, you can request restriction of data processing instead of erasure.
- If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request restriction of the processing of your personal data instead of erasure.
- If you have lodged an objection pursuant to Art. 21 para. 1 GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.
If you have restricted the processing of your personal data, this data may — apart from being stored — only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.
SSL/TLS Encryption
This site uses SSL/TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or requests you send to us as the site operator. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser bar.
When SSL/TLS encryption is activated, the data you transmit to us cannot be read by third parties.
Objection to Advertising E-Mails
The use of contact data published as part of the imprint obligation for the purpose of sending advertising and information materials that have not been expressly requested is hereby objected to. The operators of the pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, such as spam e-mails.
4. Data Collection on This Website
Cookies
Our websites use so-called "cookies". Cookies are small data packages that do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted after your visit ends. Persistent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.
Cookies may come from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. cookies for processing payment services).
Cookies serve various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies may be used to evaluate user behaviour or for advertising purposes.
Cookies that are required to carry out the electronic communication process, to provide certain functions that you have requested (e.g. for the shopping cart function) or to optimise the website (e.g. cookies for measuring the web audience) (necessary cookies) are stored on the basis of Art. 6 para. 1 lit. f GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG); consent may be revoked at any time.
You can set your browser to inform you about the setting of cookies and to only allow cookies on a case-by-case basis, to exclude the acceptance of cookies for certain cases or in general, and to activate the automatic deletion of cookies when the browser is closed. If cookies are disabled, the functionality of this website may be limited.
If further cookies and services are used on this website, you can find details in this privacy policy.
Consent with Klaro
Our website uses the open-source consent manager Klaro to obtain your consent to the storage of certain cookies on your device or to the use of certain technologies and to document this in a data protection-compliant manner. Klaro is delivered entirely from our own servers, so no connection to third-party servers is established for this purpose.
When you make your selection, a cookie named "klaro" is stored in your browser, recording the consents you have given or their revocation. This cookie is stored for 365 days. Services requiring consent (Google Tag Manager / Google Analytics) are disabled by default (Google Consent Mode v2, default setting "denied") and are only loaded after your explicit consent.
Klaro is used to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6 para. 1 lit. c GDPR. You can adjust or revoke your selection at any time via the "Cookie settings" link in the footer of the website.
Contact Form
If you submit enquiries to us via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in the event of follow-up questions. We do not pass on this data without your consent.
The contact form is technically provided via Zoho Forms and embedded first-party through our own subdomain forms.nordflux.de; no third-party cookies are set and the form is accessed without a prior consent query. The provider is Zoho Corporation Pvt. Ltd., Estancia IT Park, Plot No. 140 151, GST Road, Vallancherry, Chengalpattu District 603202, India. Zoho uses data localisation: customer data from the European Union is processed in data centres within the EU. We have concluded a data processing agreement with Zoho. Zoho's privacy policy can be found at: https://www.zoho.com/privacy.html.
The processing of this data is based on Art. 6 para. 1 lit. b GDPR if your enquiry is related to the performance of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR) if this has been requested; consent may be revoked at any time.
The data you enter in the contact form will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions — in particular retention periods — remain unaffected.
Enquiry by E-Mail, Telephone or Fax
If you contact us by e-mail, telephone or fax, your enquiry, including all personal data arising from it (name, enquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.
The data you send us via contact enquiries will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your request has been fully processed). Mandatory statutory provisions — in particular statutory retention periods — remain unaffected.
Communication via WhatsApp
For communication with our customers and other third parties, we use, among other things, the instant messaging service WhatsApp. The provider is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland.
Communication takes place via end-to-end encryption (peer-to-peer), which prevents WhatsApp or other third parties from gaining access to the communication content. WhatsApp does, however, gain access to metadata generated in the course of communication processes (e.g. sender, recipient and time). We further note that WhatsApp, according to its own statements, shares personal data of its users with its parent company Meta, based in the USA. Further details on data processing can be found in the WhatsApp privacy policy at: https://www.whatsapp.com/legal/#privacy-policy.
The use of WhatsApp is based on our legitimate interest in the fastest and most effective communication possible with customers, prospects and other business and contractual partners (Art. 6 para. 1 lit. f GDPR). If appropriate consent has been requested, data processing is carried out exclusively on the basis of consent; consent may be revoked at any time with effect for the future.
The communication content exchanged between you and us via WhatsApp will remain with us until you request deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions — in particular retention periods — remain unaffected.
The company holds a certification under the "EU-US Data Privacy Framework" (DPF). The DPF is an agreement between the European Union and the USA that is intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/7735.
We use WhatsApp in the "WhatsApp Business" variant.
The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.whatsapp.com/legal/business-data-transfer-addendum.
We have configured our WhatsApp accounts so that there is no automatic data synchronisation with the address book on the smartphones used.
Zoho CRM

Details on the functions of Zoho CRM can be found here: https://www.zoho.com/de/crm/features.html.
The use of Zoho CRM is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the most efficient customer management and customer communication possible. If appropriate consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG, insofar as the consent covers the storage of cookies or access to information on the user's device (e.g. device fingerprinting) within the meaning of the TDDDG. Google Tag Manager
Google Tag Manager is only loaded on this website after you have given your explicit consent via our consent manager (Klaro). Without your consent, no tags are delivered and no data is transferred to Google (Google Consent Mode v2, default setting "denied").
We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.
Google Tag Manager is a tool that allows us to integrate tracking or statistics tools and other technologies on our website. Google Analytics
We only use Google Analytics 4 after your explicit consent via our consent manager (Klaro). Without consent, the service remains completely disabled (Google Consent Mode v2, default setting "denied"); no cookies are set and no data is transferred to Google.
This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, dwell time, operating systems used and the origin of the user. This data is aggregated in a user ID and assigned to the respective device of the website visitor.
Furthermore, we can use Google Analytics to record, among other things, your mouse and scroll movements and clicks. Google Analytics also uses various modelling approaches to supplement the recorded data sets and uses machine learning technologies in data analysis.
Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.
The use of this service is based on your consent pursuant to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG. Consent may be revoked at any time.
The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://business.safety.google/adscontrollerterms/sccs/.

Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.
IP Anonymisation
Google Analytics IP anonymisation is activated. As a result, your IP address is truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area before transmission to the USA. Only in exceptional cases is the full IP address transferred to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activities and to provide other services related to website usage and internet usage to the website operator. The IP address transmitted by your browser in the context of Google Analytics will not be merged with other Google data.

6. Newsletter
Newsletter Data
If you would like to subscribe to the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. No further data is collected, or only on a voluntary basis. For the processing of newsletters, we use newsletter service providers, which are described below.
Zoho Campaigns
This website uses Zoho Campaigns for sending newsletters. The provider is Zoho Corporation Pvt. Ltd., Estancia IT Park, Plot No. 140 151, GST Road, Vallancherry Village, Chengalpattu Taluk, Kanchipuram District 603 202, India (hereinafter "Zoho Campaigns").
Zoho Campaigns is a service that can be used, among other things, to organise and analyse the sending of newsletters. The data you enter for the purpose of subscribing to the newsletter is stored on the servers of Zoho Campaigns.
Data Analysis by Zoho Campaigns
With the help of Zoho Campaigns, we are able to analyse our newsletter campaigns. For example, we can see whether a newsletter message was opened and which links were clicked, if any. In this way, we can also determine which links were clicked particularly often.
We can also recognise whether certain predefined actions were carried out after opening/clicking (conversion rate). For example, we can see whether you made a purchase after clicking on the newsletter. If you do not want analysis by Zoho Campaigns, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message. Zoho Campaigns also enables us to divide newsletter recipients into various categories ("clustering"). Recipients can be segmented, for example, by age, gender or place of residence. In this way, newsletters can be better tailored to the respective target groups. If you do not want analysis by Zoho Campaigns, you must unsubscribe from the newsletter. A corresponding link is provided in every newsletter message for this purpose.
Data Localisation
Zoho Campaigns uses data localisation. Customer data from the European Union is stored and processed exclusively in data centres within Europe. The assignment to the data region is carried out automatically based on the domain chosen during registration and the IP address. When logging in via campaigns.zoho.eu, the European data centre is assigned by default. Further information on data localisation at Zoho and the data centres used can be found at https://www.zoho.com/know-your-datacenter.html and https://www.zoho.com/campaigns/help/developers/data-centers.html.
Detailed information about the features of Zoho Campaigns can be found at the following link: https://www.zoho.com/campaigns/features.html.

The transfer of data to the USA is based on the standard contractual clauses of the EU Commission. Details can be found here: https://www.zoho.com/privacy.html.
Storage Duration
The data stored with us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe or after the purpose ceases to apply. We reserve the right to delete or block email addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR. Data stored with us for other purposes will not be affected by this.
After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider in a blacklist, if this is necessary to prevent future mailings. The data from the blacklist is used solely for this purpose and is not merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). Storage in the blacklist is not subject to a time limit. You may object to the storage if your interests outweigh our legitimate interest.

Google reCAPTCHA
We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on this website. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.
reCAPTCHA is used to check whether data entered on this website (e.g. in a contact form) has been entered by a human or by an automated program. To do this, reCAPTCHA analyses the behaviour of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For the analysis, reCAPTCHA evaluates various pieces of information (e.g. IP address, time spent on the website by the visitor or mouse movements made by the user). The data collected during the analysis is forwarded to Google.
reCAPTCHA analyses run entirely in the background. Website visitors are not informed that an analysis is taking place.
In this context, Google acts as a pure data processor within the meaning of Art. 28 GDPR and will not use the data collected in this way for its own purposes. The tool is used on the basis of a data processing agreement (DPA) with Google.
The storage and analysis of data is carried out on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web services from abusive automated spying and from spam. If consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG, insofar as the consent includes the storage of cookies or access to information on the user's device (e.g. device fingerprinting) within the meaning of the TDDDG. The consent can be revoked at any time.

Processing of Customer and Contract Data
We collect, process and use personal customer and contract data for the purpose of establishing, defining the content of and amending our contractual relationships. We only collect, process and use personal data about the use of this website (usage data) to the extent necessary to enable the user to make use of the service or to bill them for it. The customer data collected will be deleted after completion of the order or termination of the business relationship and expiry of any statutory retention periods that may exist. Statutory retention periods remain unaffected.
9. Audio and Video Conferences
Data Processing
We use online conference tools, among other means, to communicate with our customers. The tools we use individually are listed below. When you communicate with us via video or audio conference over the internet, your personal data will be recorded and processed by us and the provider of the respective conference tool.
The conference tools collect all data that you provide/deploy for use of the tools (e-mail address and/or your telephone number). Furthermore, the conference tools process the duration of the conference, the start and end (time) of participation in the conference, the number of participants and other "context information" in connection with the communication process (metadata).
The tool provider also processes all technical data required to handle online communication. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.
If content is exchanged, uploaded or otherwise made available within the tool, it is also stored on the servers of the tool providers. Such content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information shared during the use of the service.
Please note that we do not have full control over the data processing procedures of the tools used. Our options are largely governed by the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the privacy policies of the tools used, which we have listed below this text.
Purpose and Legal Bases
The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6 para. 1 lit. b GDPR). Furthermore, the use of the tools serves the general simplification and acceleration of communication with us or our company (legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR). Where consent has been requested, the tools in question are used on the basis of this consent; the consent can be revoked at any time with effect for the future.
Storage Duration
The data collected directly by us via the video and conference tools will be deleted from our systems as soon as you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory retention periods remain unaffected.
We have no influence over the storage period of your data that is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.
